Buddhist Chung Wah Kornhill Primary School Parent-Teacher Association Constitution

(1) Name and Address:
Name: This association shall be named the "Buddhist Chung Wah Kornhill Primary School Parent-Teacher Association" (hereinafter referred to as "the Association").

(2) Objectives and Functions:

  1. Strengthen the connection between parents and teachers to foster friendships among members.
  2. Enhance communication and collaboration to promote educational development.
  3. Focus on students' moral character to improve their personal conduct and academic performance.
  4. Improve school facilities to enhance student welfare.
  5. Organize various cultural and recreational activities to encourage parents, teachers, and students to integrate into the school community.
  6. According to the amendments of the 2004 Education Ordinance (Section 40AO) and the Constitution of the Incorporated Management Committee (IMC) of the school, assist in the formation and election of parent representatives to serve on the IMC.

(3) Membership and Members' Rights and Duties:

  1. Membership
    1.Regular Members: All current parents or guardians of the school's students automatically become "Regular Members" of the association. However, only one representative per family is allowed to participate.
    2.Ex-officio Members: The school's current principal and teachers are "Ex-officio Members" and are exempt from paying annual dues.
    3.Honorary Members: Past chairpersons and committee members, as well as distinguished individuals invited by the Executive Committee, are "Honorary Members." Honorary Members are exempt from paying annual dues. Honorary and Regular Memberships cannot overlap; if an Honorary Member's child is enrolled in the school, their status will revert to Regular Member.
  2. Rights
    "Regular Members" and "Ex-officio Members" have the right to propose, vote, elect, be elected, and participate in activities organized by the association.
    "Honorary Members" do not have the rights to propose, vote, elect, or be elected but can participate in the association's activities.
  3. Duties
    Members are obliged to attend general meetings and extraordinary general meetings, comply with the association's constitution, and abide by the resolutions passed by the general meeting or the Executive Committee.
    Members must pay the annual subscription fee as determined by the Executive Committee.

(4) Organization:

  1. General Meeting
    The General Meeting is the highest authority in the association and consists of all members. It is held once a year, usually at the beginning of the school year (around November). The meeting quorum requires at least 5% of all members to be present. If a quorum is not met, a second meeting will be held, which shall proceed regardless of attendance.
    Responsibilities of the General Meeting

    1.Amend the constitution.
    2.Elect Executive Committee members.
    3.Discuss and promote association affairs and approve financial reports.
     
  2. Extraordinary General Meeting
    If 20% or more members jointly propose a motion, an Extraordinary General Meeting may be convened. The Executive Committee must notify all members at least one week in advance. Procedures and quorum requirements are the same as those of the General Meeting. Only proposed motions may be discussed, and no new motions can be added.
     
  3. Executive Committee
    The Executive Committee manages the association's affairs. The school supervisor, directors, and principal serve as advisors by default. The committee consists of 6 to 10 "Regular Members" elected by members and 5 to 7 "Ex-officio Members," including the vice principal as an automatic Vice Chairperson. Other positions are elected internally within the Executive Committee.

Executive Committee Positions and Responsibilities

  1. Chairperson (held by a parent): Responsible for convening and presiding over general, extraordinary, and committee meetings; leading the committee in executing duties; reporting on activities and finances; and organizing elections for the committee.
  2. Two Vice Chairpersons (one parent, one vice principal): Assist the Chairperson in implementing all duties; act as Chairperson in their absence.
  3. Two Secretaries (one parent, one teacher): Handle the association's correspondence and keep minutes in both Chinese and English.
  4. Two Treasurers (one parent as primary treasurer, one teacher as deputy): Manage all financial accounts, prepare annual financial statements, and submit reports for committee approval and subsequent presentation at the General Meeting.
  5. Recreation Officers (15 parents and 13 teachers): Organize all recreational activities of the association.
  6. General Affairs Officers (one parent, one teacher): Oversee membership, volunteers, and management team matters.
  7. Advisors (default advisors include the school supervisor, directors, and principal).

In Executive Committee elections, three parents with the next highest number of votes become reserve committee members and fill vacancies in order of rank.

(5) Management and Administration:

  1. At least two weeks before the General Meeting, the Executive Committee Chairperson must notify members in writing of the meeting's date, time, location, and agenda.
  2. Any motion requires approval from over half of the attending members to pass. In the case of a tie, the Chairperson has the casting vote.
  3. The Executive Committee must hold at least two meetings annually. A quorum for committee meetings requires at least half of its members to be present. In the case of a tie during voting, the Chairperson has the casting vote. Members who miss two consecutive meetings without reasonable cause may be dismissed by a committee vote.
  4. The committee has the right to terminate memberships of individuals who breach the association's objectives or damage its reputation.
  5. The committee can appoint task groups to organize specific events. These task group members are not required to be committee members and will disband after completing their tasks.
  6. Except for Ex-officio Members, the term of Executive Committee members is two years; re-elected members may serve consecutive terms.
  7. All Executive Committee positions are voluntary and unpaid.
  8. Meeting minutes (from General Meetings and Executive Committee meetings) must be submitted to the School Board for record-keeping.
  9. The School Board has the right to veto any resolutions or actions that conflict with the association's objectives.

(6) Finance:

  1. The treasurer collects membership fees and other income, which must be deposited into a designated bank account. All funds require joint signatures from one of the following: the Chairperson, Parent Vice Chairperson, Parent Treasurer, or the Principal/Vice Principal.
  2. Expenses must align with the association's objectives or administrative needs.
  3. The Executive Committee has the authority to allocate funds, and any task group expenses must first gain committee approval.
  4. The fiscal year runs from September 1 to August 31 of the following year.
  5. Receipts and expenditure records must be kept for three years; records older than three years will be discarded.
  6. The treasurer must report the financial status at each Executive Committee meeting and prepare an annual financial statement for audit by a voluntary auditor and approval at the General Meeting.

(7) Audits:

The General Meeting elects a voluntary auditor to review the annual financial statements at the end of the fiscal year.

(8) Dissolution and Constitutional Amendments:

  1. If the School Board determines that the associations activities or resolutions contravene the schools mission, it may move to dissolve the association.
  2. Dissolution requires approval from at least two-thirds of attendees at a General or Extraordinary General Meeting. Remaining assets, after dissolution, can be donated to the school or other charities as decided by the General Meeting.
  3. Amendments to the constitution also require approval from at least two-thirds of attendees at a General or Extraordinary General Meeting. Members must be notified in writing at least two weeks prior, specifying the proposed amendments. Once approved, the amendments must be submitted to the relevant registry within seven days. If no objections are raised within 28 days, the amendments automatically take effect.
